Mandatory 10-Day Waiting Period
Every firearm transferāwhether itās a handgun, rifle, or shotgunāwill be subject to a 10-calendar-day waiting period.
Waiting Period Starts When the Background Check Is Initiated
Unlike previous processes that centered around the approval date, this new rule starts the countdown when the New York National Instant Criminal Background Check System (NY NICS) is initiated. That means the clock starts ticking the moment your background check begins, not when it's cleared.
No Early Transfers Allowed
Even if your background check is approved immediately, you must still wait the full 10 days before taking possession of your firearm. There are no exceptions built into the legislation for early clearance.
The bill was introduced by Senator Michael Gianaris and gained approval in the Senate by a vote of 40 to 22. Its companion bill, Assembly Bill A.1210, is currently under consideration by the Assembly Codes Committee.
